1. Agreement to Terms
These Terms of Service (“Terms”) are an agreement between you and BlastOut Solutions regarding access to and use of Creeper OS, including the website, web application, mobile application, desktop application and related services (together, the “Services”).
By creating an account, starting a trial, signing an order, inviting users, or otherwise using Creeper OS, you agree to these Terms. If you use the Services on behalf of a business, you represent that you have authority to bind that business, and “you” includes that business.
If you do not agree, do not use the Services. These Terms are a product agreement, not legal advice.
2. About Creeper OS
Creeper OS is a unified retail operating system intended to help retailers manage connected operations such as POS billing, inventory, product and SKU management, procurement, customers, suppliers, sales, payments or transaction records, multi-store administration, reports and related retail workflows.
Creeper OS is designed for jewellery, textile, grocery, pharmacy, home appliances, general retail, service-plus-product businesses and other small and medium-sized retail operations. Features available to you depend on the plan, configuration and modules enabled for your account.
3. Eligibility and Account Requirements
The Services are intended for businesses and authorised adult users acting in a commercial capacity. You must be legally able to enter a binding contract and must not be barred from receiving the Services under applicable law.
You are responsible for ensuring that your use of Creeper OS, including any industry-specific use such as pharmacy or jewellery operations, complies with laws and licences that apply to your business. Creeper OS does not itself grant trade licences or regulatory approvals.
4. Account Registration and Security
You must provide accurate information when registering and keep it reasonably current. You are responsible for all activity that occurs under your account and under user credentials you issue.
Keep passwords, PINs, recovery methods and devices secure. Assign roles carefully. Notify us promptly if you believe unauthorised access has occurred. We may require additional verification where reasonably needed to protect the account or the platform.
5. Business Customer Responsibilities
If you are a merchant, you are responsible for how your organisation uses Creeper OS in the shop, warehouse, office and any other location you connect. That includes configuring stores, catalogues, taxes, rates, users, hardware and workflows in a way that matches your actual business practice.
You remain responsible for your relationships with your own customers, suppliers, staff and regulators. Creeper OS is a software platform that records and organises operational information you and your team enter or generate; it does not operate your retail business for you.
6. Acceptable Use
You may use the Services only for lawful retail and related business purposes. You agree not to:
- Use Creeper OS for illegal activity, including fraud, money laundering, or trade in goods or services that you are not permitted to sell.
- Attempt unauthorised access to accounts, systems, networks or data that are not yours.
- Probe, scan, overload or interfere with the Services, or attempt to bypass security, rate limits or access controls.
- Upload, transmit or distribute malware, malicious code or content designed to disrupt systems.
- Misuse other users’ information, scrape data without permission, or use the Services to harass, impersonate or deceive.
- Resell, sublicense or provide the Services to third parties except as expressly allowed in a written agreement with us.
- Reverse engineer, copy or create derivative works of the software except to the limited extent such restriction is not permitted by applicable law.
- Use the Services in a way that harms other customers, the platform, or BlastOut Solutions.
We may investigate suspected violations and take action we reasonably consider necessary, including suspension, as described later in these Terms.
7. Use of Business Data
As between you and BlastOut Solutions, you retain ownership of the business data you submit to Creeper OS, including catalogues, inventory, bills, customer records you enter, supplier records and similar operational content (“Customer Data”), subject to these Terms and applicable law.
You grant BlastOut Solutions a non-exclusive right to host, process, transmit, display, backup and otherwise use Customer Data solely as needed to provide, maintain, secure and support the Services, and to meet legal obligations.
We may also use de-identified or aggregated information derived from use of the Services to improve Creeper OS, understand product performance and maintain security, provided it is not used to identify your business or individuals in ordinary product communications.
Our handling of personal information is described in the Privacy Policy.
8. Customer Responsibilities
You are responsible for:
- Account credentials, devices and the people you authorise to use Creeper OS.
- Setting user permissions that match actual job roles.
- The accuracy, quality and legality of information entered into the platform.
- Using the Services in accordance with applicable law, including tax, invoicing, consumer, labour and sector rules that apply to you.
- Your own customer relationships, including how you collect and use personal data about your shoppers or clients.
- Appropriate handling of personal data you store in Creeper OS, including any notices or consents required for your business.
- Maintaining independent business records as needed for your own continuity, audits and statutory obligations.
9. Subscription, Trial and Pricing
Access to Creeper OS may be offered through a trial, a subscription plan, a custom package or another commercial arrangement. Current published packages are described on our pricing page. The features, term, fees and any add-ons that apply to you are those stated in the plan, order, invoice or onboarding terms you accept.
Trials, if offered, are provided so you can evaluate the product. Trial access may be limited in duration, features or support, and may be withdrawn if used in a way that is abusive or inconsistent with evaluation use.
We may change published prices or packages for future terms. Changes that affect an existing paid term will be handled according to the applicable order or notice we provide.
10. Payments
You agree to pay the fees that apply to the plan, add-ons or professional services you select, according to the payment method and schedule agreed during purchase or onboarding.
Unless stated otherwise in a written order, fees are exclusive of applicable taxes, which you are responsible for paying. Late or failed payment may result in reminders, suspension of access, or other remedies permitted by the agreement and applicable law.
Refunds, if any, are governed by the specific commercial terms provided at purchase or in a written agreement. These Terms do not create a general right to a refund.
11. Intellectual Property
Creeper OS software, branding, user interface, designs, documentation, templates, workflows and related technology are owned by BlastOut Solutions or its licensors. Except for the limited right to use the Services during the term, no intellectual property rights are transferred to you.
You may not copy, modify, distribute or publicly display the software or branding except as needed for ordinary authorised use of the product or as permitted by a separate written licence.
Customer Data remains yours, as described above. Feedback you provide about Creeper OS may be used by us to improve the product without an obligation to you.
12. Third-Party Services
Creeper OS may interoperate with third-party services, hardware, communication channels, hosting providers or other tools. Those services are provided by their own operators and may have separate terms and privacy policies.
We are not responsible for third-party services we do not control, including their availability, security or handling of information once data leaves Creeper OS at your direction. Enable integrations only if you accept those third-party terms.
13. Availability and Service Changes
We aim to keep Creeper OS reliable and available. We do not guarantee uninterrupted, error-free or always-online service. Connectivity, local hardware, power, internet providers and events outside our reasonable control can affect use, including at the billing counter.
We may modify, improve, suspend or discontinue features where reasonably necessary for security, legal, operational or product reasons. Where a change materially reduces core paid functionality, we will take reasonable steps to notify affected customers in advance, unless urgent action is required.
14. Support
Support is available through the contact channels published on our website, including email and phone. The level of assistance may vary by plan, implementation stage and the nature of the request.
We do not commit to a fixed response time in these Terms. If a separate onboarding or support arrangement states specific coverage, that arrangement governs to the extent it is more specific.
15. Data Backup and Recovery
We may use reasonable backup and recovery practices as part of operating the Services. Those practices are intended to support platform continuity; they are not a substitute for your own record-keeping.
You should retain copies of invoices, statutory records, catalogues and other information your business is required or reasonably expected to keep. Creeper OS should not be your only copy of records you cannot afford to lose.
16. Suspension and Termination
You may stop using the Services and request cancellation of your account through the published contact channels, subject to any minimum term or notice in your plan or order.
We may suspend or terminate access where reasonably necessary, including for non-payment, material breach of these Terms, security threats, illegal use, abuse of the platform, or if required by law. Where practical and legally permitted, we will give notice and a chance to remedy before a lasting termination.
17. Effect of Termination
When access ends, your right to use Creeper OS stops. You should export or copy any Customer Data you need before cancellation takes effect, where export tools or assistance are available.
Subject to applicable law and the applicable service agreement, data may be retained or deleted according to Creeper OS’s data retention practices. We are not obliged to retain Customer Data indefinitely after termination unless a written agreement or law requires it.
Sections that by their nature should survive — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — continue after termination.
18. Disclaimers
Reports, calculations and records in Creeper OS depend on the data, configuration and processes you and your team supply. We do not warrant that the Services will meet every regulatory filing requirement for every retail sector or that outputs are complete for statutory purposes without your review.
To the maximum extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis. We disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement, except where such a disclaimer is not permitted.
19. Limitation of Liability
To the maximum extent permitted by applicable law, BlastOut Solutions and its team are not liable for indirect, incidental, special, consequential or punitive losses, or for lost profits, lost revenue, lost data, lost goodwill or business interruption, arising out of or related to the Services or these Terms, whether based on contract, tort or any other theory.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or for death or personal injury caused by negligence where such exclusion is not permitted.
Any remaining liability relating to the Services will be limited to the fees you actually paid to BlastOut Solutions for the Creeper OS services giving rise to the claim during the twelve months before the claim, or such other amount as applicable law requires. The precise allocation of risk in a particular commercial contract may be set out in a signed order or service agreement, which should be reviewed by qualified legal counsel.
20. Indemnification
To the extent permitted by applicable law, you will defend and indemnify BlastOut Solutions against third-party claims, damages and reasonable costs arising from: (a) Customer Data you submit; (b) your unlawful use of the Services; (c) your violation of these Terms; or (d) your handling of personal data relating to your own customers or staff, except to the extent the claim is caused by our wilful misconduct or a failure we cannot disclaim under applicable law.
21. Governing Law
These Terms are governed by the laws of India, subject to applicable law. Mandatory consumer or other protections that cannot be waived in your location continue to apply.
The parties will first try to resolve disputes through good-faith contact using the details below. If a dispute proceeds further, it will be handled in accordance with applicable law.
22. Changes to Terms
We may update these Terms as the product, pricing model or legal environment changes. The current version will be posted on this page with a revised last-updated date.
If a change is material, we may provide additional notice through the service or by email. Continued use after the effective date of updated Terms constitutes acceptance, except where applicable law requires a different method of agreement. If you do not agree, you should stop using the Services and contact us about ending the account.
